What should be the reasonable amount for settlement in housing discrimination case?
We had been discriminated by a property manager and were refused for tenancy and we have proof to prove in court.Now the property management is company is ready for settlement and government agency is asking what is the amount you are expecting for settlement?
What is the maximum amount we can expect as settlement?
I repeat we have strong evidence to prove in court.
We lost $60 screening fees we paid and there is hard inquiry on our credit score(husband and wife both)
Apart from money lost, we are are hurt due to discrimination based rejection
What damages did you suffer? That is what you will get in court, and possibly an injunction ordering the company not to do it again. If the actions were absolutely egregious and shock the conscious, you might get punitive damages, although those damages will almost never be more than nine times your actual monetary damages and usually punitive damages will be much less than that.
So it all depends on how much money you have lost due to the discrimination, and if you can prove all that money was truly lost.
As for being hurt due to being discriminated against, unless you suffer really badly (like having to seek therapy) you won't be compensated for it. Even if you truly are so upset that therapy is needed, and the judge buys that story, the most you would get for that would be reimbursement for the costs of therapy.
If you can prove some sort of damage to your credit rating that can't be fixed with phone calls and a court decree, you MIGHT get something for it, but it is doubtful. Sounds like you won't be getting a big payday out of this.
