In a hearing for contempt of court for failure to pay child support defendant takes stand first?
In a child support case for failure to pay child support the plaintiffs attorney called the defendant to testify first, is this normal? I mean I've never heard of the defendant to testify before the plaintiffs testimony. Am I wrong or should have the defendants attorney denied the testimony until plaintiff presented their case first?
The plaintiff goes first. The plaintiff can call whomever he or she wants to call since they get to present their side of the case first. If it makes sense and the defendant's testimony can be helpful, then why not? Sometimes a plaintiff will call the defendant to throw the defendant off balance or to insure there is specific evidence to be presented. Sometimes the plaintiff needs to call the defendant in the event the defendant chooses not to testify in his or her own defense. There is certainly no rule against it.
